These are our terms for buying. For using the website, see our Website terms.

These terms apply when you acquire a digital Collectible from us through octarr.com and members.octarr.com, for example a DARA Collectible. Please read them before you pay. You can save or print this page.

1. Who we are

2. What you acquire

One numbered digital DARA Collectible, one of 1,000. It appears in your collection on OCTARR with its number, usually right away after successful payment and at the latest within 7 days. It has its own public Passport page on id.octarr.com, showing the artwork, its provenance and the status of its Digital Record, and never your name. Later it will also receive its Digital Record, a token on the Base blockchain. The contract for it doesn't exist yet, and we can't give a date. It includes OCTARR collector membership: your member account with your collection and the Collectible's Passport, and no other benefits.

Both DARA options, Collector (€89) and Artist (€55, by invitation), give the same Collectible and the same rights. Only the price and who may choose it differ.

What you may do with it. You may view your Collectible and its image in your collection and on its Passport, and show that image for personal, non-commercial purposes, crediting DARA and OCTARR. That is all: no other intellectual property rights are given. Copyright in the images and the works stays with the artists and OCTARR.

What it is not. A DARA Collectible gives you no ownership of the tree, its wood or paper, or any physical work made from them. It is not a share in anything, and it gives no right to sale proceeds, income, profit or any return. It includes no rewards or credits. You can't pass it on at launch.

3. Who can buy

You can buy if you are 18 or over and buy as a private individual (a consumer), wherever you live. Buying for a company or with a VAT number isn't possible.

Each option has a limit per person; for DARA it is 100. Each checkout is for one Collectible. The Artist option (€55) is for invited artists and makers.

4. Price and payment

Prices are in euros and include 21% Dutch VAT. The price is the same for every buyer, wherever you live; the checkout says "VAT included". The price you pay is the price shown at checkout before you pay; if it differs from a price on our website, the checkout's price applies and you see it before paying. There are no other fees.

You pay by card, Apple Pay, Google Pay or Link through our payment provider, Stripe. Your card details go straight to Stripe. OCTARR never sees your card number.

Stripe emails you a receipt. Your invoice is in your collection on OCTARR.

5. How buying works

  1. Confirm your email. We send you a link. Opening it confirms your address and signs you in. If this is your first acquisition, it also creates your OCTARR account.
  2. Your details. Your name and the country of your billing address, for the invoice; the rest of the address is optional. Before you pay, the checkout reminds you that you are buying as a private person. You can choose to save the address for next time.
  3. Reservation. When you continue to payment we hold one Collectible for you for 15 minutes. If the reservation ends before you pay, you are not charged. If it ends while a payment is being completed, the payment taken is returned to you by Stripe.
  4. Payment. You pay in Stripe's secure field. If you close the page during payment, we still complete your acquisition, and you won't be charged twice.
  5. Confirmation. The contract is made when your payment is confirmed. The checkout then confirms your acquisition, and we email you a confirmation with your order details, a link to withdraw online, and links to these terms (with the model withdrawal form in section 7), our refund policy and our privacy policy. If your Collectible isn't in your collection right away, we email you again when it is.

6. Delivery

A Collectible is digital content. We deliver it by placing it in your collection on OCTARR with its number. This happens usually right away after successful payment, and at the latest within 7 days.

Its Digital Record is created after that, in the background. You don't need to do anything for it.

At launch you can't move your Collectible or its Digital Record to a wallet of your own, or pass it on. Once the Digital Record exists, it is freely transferable, and whoever holds it becomes the Collectible's collector; these terms will then describe how. We'll tell you when that is.

7. Your right to withdraw

You may withdraw from your purchase within 14 days of the day the contract is made, without giving a reason. Delivering your Collectible straight away doesn't shorten this period, and we don't ask you to give it up.

How to withdraw. Any of these works, as long as you send it before the 14 days end:

  1. Online, on our withdrawal page:members.octarr.com/withdraw. On the page "Withdraw from a purchase", fill in your full name, your order number (shown on your confirmation and in your collection; a receipt or invoice number works too) and the email address you bought with, then choose "Confirm withdrawal". We email you a confirmation straight away with what you sent, and the date and time. You don't need to sign in.
  2. By email to info@octarr.com.
  3. With the model withdrawal form below, by email or by post to Wegotthis BV, Hoogstraat 65, 5615 PA Eindhoven, the Netherlands.

What happens next. We refund the full amount automatically, using the payment method you paid with, within 14 days of receiving your withdrawal. Stripe emails you a refund receipt. We take the Collectible back: it leaves your collection, and its number is retired for good. It is never sold again.

8. Refunds

See our refund policy. A refund goes back to the payment method you used, through Stripe, and Stripe emails you a refund receipt.

9. If something goes wrong

If your Collectible hasn't appeared in your collection within the period in section 6, or you think something is wrong, email info@octarr.com. Your statutory rights as a consumer apply in full.

10. Complaints

Please send any complaint to info@octarr.com. We'll reply as soon as we can.

11. Law

Dutch law applies.

12. Changes

We may update these terms for future purchases. The version shown when you paid applies to your purchase.
